Welcome. These Terms are a contract between you and Mr Tayne Rongo trading as Seaqae Group (ABN 40 300 987 116), operator of Cold Case Club ("we", "us", "our"). Using the Service means you accept these Terms.
Cold Case Club is a fictional-mystery subscription. Subscribers receive physical evidence packets by mail at regular intervals and progress through a serialised case. All cases, characters, events, and evidence are works of fiction; any resemblance to real persons or events is coincidental.
Prices are in US Dollars and exclude applicable taxes. Payment is processed by Stripe under its own terms. For Australian customers, GST is included at the prevailing rate once we exceed the GST registration threshold.
Auto-renewal disclosure (California SB-313 + equivalent): Monthly subscriptions continue automatically at $14.99 USD/month until cancelled. Cancel anytime in two clicks from your order confirmation email or by emailing hello@coldcaseclub.store. We will send a renewal reminder before each billing cycle.
Packets ship worldwide. Australia and New Zealand via Australia Post; international via standard airmail. Typical delivery: 5–10 business days domestic, 10–21 business days international. If a packet is lost or damaged in transit, contact us within 30 days of the expected delivery date and we'll replace it free of charge.
Our Refund Policy sets out your full rights. In summary:
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
The above reservation applies equally to: the UK Consumer Rights Act 2015, the EU Consumer Rights Directive 2011/83/EU, the Canadian Consumer Protection Acts, and applicable US state consumer-protection statutes (including California's Song-Beverly and Rosenthal Acts). Statutory rights in your jurisdiction apply in addition to anything written here.
You must be at least 16 years old to purchase a subscription. Our content features fictional crime and mystery themes unsuitable for younger children. We do not knowingly collect information from anyone under 13; if we discover we have, we delete it.
All case files, character names, artwork, photography, code, and text are our property or used under licence. You may photograph evidence you receive and share it on social media — we encourage it. You may not reproduce, commercially distribute, resell, or adapt our materials without written permission.
You agree not to: resell access to the Service; reverse-engineer our checkout, packet, or server infrastructure; attempt to access other subscribers' accounts or data; use the Service to harass, defame, or impersonate anyone; transmit malware, or use automated scraping tools against our website or API.
Our Privacy Policy covers how we collect, use, store, and delete your personal information, including your rights under the Australian Privacy Principles, the EU/UK GDPR, the California Consumer Privacy Act, and the Canadian PIPEDA.
Subject to clauses 5 and 6, our total aggregate liability arising from the Service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential loss (including lost opportunity or emotional distress) except where that exclusion is prohibited by applicable consumer-protection law.
We may update these Terms from time to time. Material changes will be notified to active subscribers by email at least 14 days before taking effect. Continued use of the Service after that date is acceptance of the revised Terms.
These Terms are governed by the laws of Western Australia. Subject to any non-excludable consumer protection law in your jurisdiction, disputes are to be brought in the courts of Western Australia. If you are a consumer in another country, your mandatory local consumer rights still apply.
